Die Umsätze der deutschen Musikindustrie sind seit dem Jahre 1997 rückläufig. Der Weltverband der Phonoindustire IFPI stellte durch Studien in 16 unterschiedlichen Ländern eine geschätzte Gesamtanzahl von 40 Milliarden illegalen Downloads alleine in 2008 fest, die auf einen Piraterie Anteil von 95% im digitalen Bereich schließen lassen. Neue Messungen in Deutschland ergaben eine erneute Steigerung auf 316 Millionen illegal heruntergeladenen Musikdateien. Durch die fortschreitende Digitalisierung und die dadurch entstandene illegale Piraterie sind Umsatzeinbußen in Milliardenhöhe weltweit zu verzeichnen, die sich in massiven Entlassungen im Bereich der Musikindustrie spiegeln. Diese negative Entwicklung und die Auswirkungen auf die Wirtschaft unterstreichen die Notwendigkeit illegale Downloads einzudämmen und Lösungsansätze zu finden. Das Thema der Arbeit entsprang neben den aktuellen Entwicklungen im Musikmarkt primär durch die neuen Messungen von illegalen Downloads weltweit. Die Handlungsempfehlungen zur Einführung von innovativen technischen Systemen und strategischen Ansätzen zur Eindämmung, aufbauend auf der Analyse der rechtlichen Gegebenheiten, der aktuellen Downloadmöglichkeiten und die durch das Internet veränderte Vertriebsstruktur, waren das Ziel dieser Arbeit. Dazu wurden nicht nur die Implementierung von technischen Lösungen, sondern auch allgemeine bewusstseinsverändernde Maßnahmen, die zu einer Umsatzsteigerung führen könnten, eruiert. Im Verlauf der Entwicklung dieser Handlungsempfehlungen wurden nach der Beschreibung der aktuellen Downloadmöglichkeiten zum illegalen Herunterladen von Musikdateien (Kapitel 2) die Umsatzzahlen der deutschen Musikindustrie bis in die achtziger Jahre vorgestellt und analysiert (Kapitel 3). Im Rahmen dieser Untersuchung wurden die Umsatzzahlen einer Inflationsbereinigung unterzogen um einen qualitativen Vergleich der Verkäufe vornehmen zu können. Anschließend wurde neben der Analyse der auf die illegalen Downloads bezogenen relevanten Gesetzestexte eine Beschreibung der bereits aktiven technischen Maßnahmen vorgenommen. Abschließend wurden durch die Zusammenführung dieser Entwicklungen, strategische wie auch technische Möglichkeiten zur Eindämmung illegaler Downloads entwickelt und überprüft (Kapitel 5).
